Listing Agent Not cooperative?

My sister was appointed trustee of a family trust by my mother (82, California). Currently, my mother is visiting here in Arizona. She has asked me to assist her to regain control over her assets (if any remain). From what I understand, my mother’s home was removed from the trust and put on the market for sale. In addition, my mother had approximately one million dollars in cash deposits. According to my mother, she has no money for expense or daily use. I purchased her airfare and she is asking me to help her unravel this matter. I first contacted the listing real estate agent who was not helpful. My sister does not take calls. My mother’s appearance suggests less than great grooming, health, and [possibly] necessary medical attention. I have been contacting (or attempting) every person, entity, office and agency I can think of. I have made little to zero progress this far. When, on occasion, I do make contact with someone who I think may be able to assist in any fashion, I hear the exact same word: "CIVIL" It may in fact be true that the only remedy for my mother is to hire an attorney to stop the sale of her home and hopefully learn if she has any money left. If I had the fund and the experience, certainly, I would move forward, However, that is not the case at the moment.. I need to find a solution and I need to tell my mother something, fairly soon. I am completely stuck. I live in Cali, but have a condo in Phoenix, AZ that I rent out.
The tenant has been there since march, 2009.. (the lease is up at the end of Feb.).

From almost the first payment the tenant paid less than the actually rent (usually ) and my property manager said if it was under , they wouldn’t charge late fees and told me it wasn’t worth paying 0 for an eviction if he is only a few dollars less.

You could see where this is going and i told my property manager last May/April that this tenant is not going to pay towards the end and walk.

Well, now this month, January he owes a total of 0 in backrent (and now late fees). The tenant told my property manager he wants to *renew his lease* and to get my OK for that before he figures out if he wants to PAY the amount already due.

He asked for a renew of the lease WAY in advance and I think it’s because if we say no, he won’t pay for Feb… If we say yes, he will do again a year of not paying rent.

Should I get rid of this tenant. It’s HARD to find one and I might go months without finding a tenant (therefore losing more money).

I DO have a "security deposit" of 0 but if he leaves with a 0 bill and doesn’t pay next months rent that almost evens out.. BUT, the cost to evict him is 0!!

What do I do??? He is a real estate agent and is just not making the money.. HELP

IF a LEASE ends at the end of Feb, do I need to give this tenant a 30 day notice still? i am TRYING to hold out on ANY notice until he actually pays for Feb. If I tell him he needs to leave at the end of Feb, now, he wont pay… Should I wait until he pays and then say I dont want to renew the lease? (unless maybe he pays everything he owes AND the full months rent).

In fact, his people, most notably Maverick Carter, were pushing New York tremendously contrary to pretty much every report that was made throughout the process. Ultimately, a source tells me, Lebron decided against the advice of his team and “decided to play with his friends.”

On the Saturday before, we reported that the Knicks’ had a third meeting with Lebron’s people in Ohio. Two of the three were reported elsewhere, the third was immediately refuted. That meeting that including Scott O’Neil and Glen Grunwald was to iron out the numbers and finalize a deal to NY. When the Knicks finalized a deal for Amar’e Stoudemire Monday they had their first max player set, setting the stage to add another in James who seemed excited at the notion.

“I’m telling you that Amar’e swore Lebron would be a Knick 48 hours before the decision,” another source added.

To take it a step further, a source with close ties to Madison Square Garden told me a week after the decision that “employees were informed that Lebron was going to be at MSG Wednesday (July 7th) in the afternoon” and to “keep their mouths shut.”

Lebron never showed.

Moreover, a real estate agent who contacted TKB, said that James was very much interested in a posh pad in lower Manhattan but took his name out of consideration only to re-contact and restart negotiations on Tuesday.

While I could never confirm a meeting with the Knicks, TKB reported both Carter and Randy Mims were in town on Wednesday and that’s when all the steam of Lebron deciding on NY came to a head. Newsday reported first that Greenwich, CT was going to be the location for the announcement. It was also the same day that Jared Dudley and Chad Ocho Cinco went live that James was going to NY. Dudley and Stoudemire were friends and teammates in Phoenix. James was in town for Carmelo Anthony’s wedding, we were told, but after choosing Miami, he flew to South Beach and then heading back north after he, Wade and Chris Bosh were introduced. To this day Greenwich, CT still doesn’t make a shred of sense to be the location for a decision. Yes, the charity that received a very generous donation from the ad proceeds was the Boys and Girls Club, but the organization was founded in Hartford, CT, and it’s national headquarters, at one point, was in Atlanta. If Lebron were in town for Melo’s wedding, why not make the decision in Miami and fly to NY on Friday, which he ultimately ended up doing? Why not hold the announcement at ESPN in Bristol, or at the Hartford location?

I never thought that James and Chris Bosh were a tandem, but I was wrong. Bosh was always the X-Factor, I’m told, ultimately in James’ decision for this reason. Bosh had already committed to Miami to play with Wade weeks before, but wasn’t interested in taking less than a max contract thus eliminating the possibility of a “Big 3.” He didn’t feel as if leaving money on the table was in his best interest because he couldn’t make up the difference in Miami in endorsements. But during the day Wednesday when all the focus shifted to New York, Bosh understood he was the hold up and that James would choose Miami if all three took pay cuts. They realized that Pat Riley was the key to them winning multiple titles. He agreed and that’s when word started to spread that Miami was, indeed, the destination. James was in.

I have been doing some research on the various residential real estate firms out there pertaining to starting my career as a real estate agent. I’m looking at the Chandler, AZ area; near Phoenix and some of the firms i’ve noticed there are Keller Williams, Remax, Coldwell Banker, and Realty Executives. I really know that area well and enjoy it there. KW seems to have a solid program for new agents but what about the others, does one have a better repuatation than another in terms of helping new agents getting started? How about the pay structure? Do any firms offer group benefit plans? Which is best/worst for "office" fees? As a new agent, given the current state of the economy, what number of sales can a new realtor expect in their first year or what can they expect to "take-home" in their first year on average?

Also, I’m thinking of eventually getting my broker’s license after 2-3 years and say for example I start out with Coldwell Banker but end up franchising as a part of Remax, is this normal? Once I would start my own franchise, I assume i’m the only realtor there until I hire others and build it up? Do the franchiser’s assist in building the new franchise with staff support/agents? On average, how much capital does it take to start your own franchise?
